VCAT is the true peoples’ court of our state. Two million Victorians interact with it every year, whether it’s a home owner suing their plumber for poor workmanship or an owners corporation suing a lot owner for failure to pay his or her rates.

VCAT has three main divisions of law:

  1. Civil division
  2. Administrative division
  3. Human rights division

Each of these three divisions has multiple lists. Different situations will trigger a range of legislations, and the multiple lists manage the legal issues stemming from these legislations. For example, if a landlord or tenant have a retail lease dispute, then the Retail Leases Act is triggered and the matter is heard under the Retail Leases list of the Civil division at VCAT.

In almost all instances, the legislative trigger for these legal issues enable only VCAT to hear the matter rather than any other court.

Given the broad ambit of VCAT’s decision-making, it’s important to hire representation that knows and understands VCAT.
